Construction Board of Appeals

Purpose

The members of this board may hear and decide an appeal that alleges error in an order, requirement, decision or determination made by the Building Official. The board may reverse or affirm, in whole or in part, or modify the Building Official’s order, requirement, decision or determination from which an appeal is taken and make the correct order requirement, decision or determination, and for that purpose, the board has the same authority as the building official. The board shall have no power to obligate the City in any manner whatsoever. The board’s finances shall be handled in the same manner as any other board of the city. The board shall have no authority to waive any requirement contained in any of the International or National Codes.

Membership

The Construction Board of Appeals consists of five (5) members and two (2) alternate members. - appointed by City Council. The board will consist of one (1) individual from each of the following professions of disciplines: 1) a registered design professional with architectural experience or a builder or superintendent of building construction; 2) a registered design professional with engineering experience; 3) a licensed mechanical contractor; 4) a licensed electrical contractor; 5) a licensed plumbing contractor; or 6) the City Council may appoint one (1) person who is an attorney or a licensed general contractor citizen in lieu of any of the previously listed qualified persons.

Term

Five year term or until a successor has been appointed.
